VIOLATION DECISIONS GIVEN BY THE UNITED NATIONS AFTER JULY 15, 2016

In Turkey, the extrajudicial practices and decisions that began in response to the December 17/25 bribery and corruption operations and became state policy with the July 15 coup attempt have subjected thousands of people to human rights violations. Particularly after the July 15 coup attempt, serious human rights violations have occurred in detentions, arrests, and trials within the scope of the initiated investigations. These practices and decisions, which are contrary to universal legal principles as well as the Constitution and laws, have made it impossible to protect fundamental rights and freedoms through domestic legal remedies or to remedy the violations. In the current situation, there is no effective domestic remedy at the Constitutional Court, higher courts, or local courts, and most importantly, structural changes have transformed the Turkish judiciary into a judicial system under the control of the government. In this process, due to unlawful practices and decisions, there have been intensive applications to the European Court of Human Rights (ECtHR) and the United Nations.

The applications have begun to be decided by the ECtHR and relevant UN bodies. In this context, significant violation decisions have been issued regarding arbitrary and unsubstantiated interventions in the right to liberty and security, freedom of expression, freedom of association, right to a fair trial, and other fundamental rights and freedoms.

At this point, our Foundation, in order to contribute to the legal struggles of individuals harmed by the dark and lawless process in Turkey, had previously shared with you a study summarizing the human rights violation decisions given against Turkey by the ECtHR after July 15. In this study, we present for your benefit a summary of the 34 decisions rendered by the relevant United Nations bodies starting from 2017. We hope that this study, prepared in light of these decisions containing the most fundamental findings regarding universal law and constitutional safeguards, will contribute to the immediate end of human rights violations in Turkey.
